Terms of Service

These Terms govern your use of Octic, a game server hosting service operated by Lavender Software Development. They are written in plain language on purpose: you should be able to tell what you are agreeing to without a lawyer in the room.

1.Acceptance of these Terms

These Terms of Service (the “Terms”) are a legal agreement between you and Lavender Software Development (“Lavender Software Development”, “we”, “us”), the operator of Octic. By creating an account, deploying a server, or otherwise using the service, you agree to be bound by them.

If you do not agree, do not use the service. If you are entering into these Terms on behalf of a company, clan or other organisation, you confirm that you have authority to bind that organisation, and “you” refers to it.

We may also publish additional terms for specific features. Where those conflict with these Terms, the feature-specific terms prevail for that feature only.

2.Eligibility and your account

You must be at least 13 years old, or the minimum age at which you can consent to online services in your jurisdiction, whichever is higher. If you are below the age of majority where you live, you may only use the service with the involvement of a parent or guardian who accepts these Terms on your behalf.

You are responsible for everything that happens under your account. That includes keeping your sign-in credentials and any API keys you generate confidential, and ensuring everyone you give access to - staff, moderators, co-owners - complies with these Terms. Do not share your account with people you do not trust with your billing details and your world data.

One person or organisation per account. We do not permit accounts created to evade a suspension, to farm promotional credits, or to obscure who is responsible for a server.

3.The service

Octic provides hosted game servers. We provision virtual machines in Amazon Web Services regions on your behalf, install and run the game software you select, and expose controls for starting, stopping, configuring, backing up and connecting to that server.

What we do: run the compute, the network path, the storage, the control panel and the DNS plumbing. We keep the machine reachable, patched at the hypervisor level, and restorable from backup where your plan includes backups.

What we do not do: we do not moderate your game. We do not administrate your players, adjudicate in-game disputes, police your chat, or remove a plugin because someone disagreed with it. Your server is your community, and the rules in it are yours to set and enforce.

We also do not guarantee uptime on free or trial capacity. Where a plan is provided without charge, it is provided as-is and may be interrupted, throttled or withdrawn at any time. Paid plans carry the availability commitments described in section 9 - those, and not any marketing figure, are the extent of our promise.

The service is offered for game hosting. It is not a general purpose compute platform, and using it as one is a breach of section 4.

4.Acceptable use

This section is the reason we can offer shared infrastructure at all. Read it as a condition of your account, not as boilerplate.

You may use Octic to run game servers and the things that legitimately support them. You may not use it for any of the following:

  • Malware. Distributing, hosting, building or staging viruses, worms, ransomware, trojans, spyware, credential stealers or any other malicious software, or serving files designed to compromise the people who download them.
  • Attacks and attack tooling. Launching or facilitating denial-of-service attacks, port scanning, credential brute-forcing, spam, phishing, or operating booters, stressers, or any tool whose primary purpose is to degrade or gain unauthorised access to systems you do not own. This applies whether the target is another Octic customer, a third party, or us.
  • Illegal content. Hosting, sharing or transmitting material that is unlawful in the jurisdiction it is served from or to, including child sexual abuse material, material that infringes intellectual property rights, and content that violates sanctions or export controls.
  • Crypto mining. Mining cryptocurrency or running any proof-of-work workload. Game servers are billed for game workloads, and mining on them costs us money while degrading the node your neighbours are playing on.
  • Escaping the container. Attempting to break out of your server’s isolation, escalate privileges on the host, access the control plane’s credentials or metadata service, read another customer’s files, or interfere with another customer’s server in any way.
  • Circumventing limits. Reselling or subdividing the service in a way your plan does not permit, exceeding declared resource limits, or misrepresenting your identity to evade a suspension.

We investigate reports of abuse. Where we find a breach, we may suspend or terminate the affected server - and, for serious or repeated breaches, your account - with or without notice depending on the risk to other customers and to our infrastructure. Where the circumstances allow, we will tell you what we found and what would need to change.

You are responsible for what runs on your server, including plugins, mods, modpacks and uploaded files. “The plugin did it” is not a defence.

5.Billing, credits, renewals and refunds

Plans are billed in advance for the period you select. Prices are shown in US dollars and exclude any taxes we are required to collect, which are added at checkout where applicable.

  • Renewals. Subscriptions renew automatically at the end of each period until cancelled. We will make reasonable efforts to notify you before a renewal, but you remain responsible for cancelling in time - putting the reminder in your own calendar is the reliable version.
  • Failed payments. If a charge fails, we retry it and notify you. A server whose payment has failed for more than a short grace period may be stopped, and its data remains recoverable for the retention window described in our Privacy Policy before deletion.
  • Cancellation. You may cancel at any time from the dashboard. Cancellation stops future renewals; it does not automatically refund the current period.
  • Refunds. If a server fails to start, or is materially unusable because of a fault on our side, contact support@octic.host and we will make it right - by fixing the fault, extending the period, or refunding it. We do not refund periods already consumed, change-of-mind purchases after the server has run, or time lost to a fault you caused, such as a misconfigured plugin or a world file you corrupted.
  • Credits. Promotional credits are not cash, are not transferable, are not refundable, and expire on the date stated when they are issued. Credits obtained by creating multiple accounts, or by any other abuse of an offer, may be voided and the associated accounts closed.
  • Price changes. We may change prices. A change will not take effect until your next renewal, and we will give notice before it does.

6.Your content and your world data

You own your world. World saves, configuration files, plugin jars, uploaded assets, MOTD text and everything else you put on your server remain yours.

You grant us a limited licence to store, copy, transmit and process that content - only as needed to operate the service for you: to run your server, take the backups your plan includes, move data between the node and our storage, and display it back to you in the control panel. This licence is non-exclusive, worldwide, royalty-free, and ends when the content is deleted from our systems. We claim no right to publish, sell, sublicense, train models on, or otherwise use your content for our own purposes.

You are responsible for having the right to upload what you upload. Do not upload other people’s paid plugins, worlds, artwork or builds without permission, and do not upload personal data belonging to your players that you do not have a lawful basis to hold.

Back up what matters to you. Where your plan includes backups, they exist so that an accident is recoverable, not so that you can treat our storage as the only copy. Download a copy of your world periodically. We are not liable for data loss beyond what section 12 provides.

7.Third-party add-ons

The add-on browser lets you install plugins, mods and modpacks from third-party catalogues - principally Modrinth and CurseForge. Those catalogues are operated by their own companies, under their own terms of service and acceptable-use policies, and your use of them is governed by those terms as well as by these.

We do not author, review, vet, sandbox or warrant any add-on listed in those catalogues. We index them so you do not have to download and upload every jar by hand. Installing one is your decision and your risk: an add-on can crash your server, corrupt a world, conflict with another add-on, degrade performance, or contain code that does something you did not intend.

Add-on artefacts are always fetched from the provider’s own CDN. We do not rehost them, and we may stop listing a provider or a project where their terms or ours require it.

Where a project’s author has opted out of third-party distribution, the catalogue will show the project but direct you to its page instead of offering a download. Do not work around that.

8.Domains

You can attach a hostname to your server in two ways: by picking a label on a domain we operate (for example survival.octic.host), or by pointing a domain you own at us.

If you attach an external domain, you confirm that you hold the rights to it - that you own it, or that its owner has authorised you to use it for this purpose. You are responsible for renewing it, for keeping its nameservers pointed correctly, and for any content served from it.

A label on a domain we operate is a subdomain of our namespace, not a transferable asset. It is granted for as long as an active server claims it, and we may reclaim a label that is unused, is being used for abuse, or is needed for our own infrastructure.

We are not a domain registrar. Registering a domain is between you and your registrar, and disputes about who owns a domain are between you and whoever else claims it. If we receive a complaint or a legal order about an external domain pointed at your server, we may disable that hostname.

9.Availability, maintenance and scheduled downtime

We work to keep servers reachable, but the service depends on systems we do not control - AWS regions, transit networks, DNS resolvers, and the game publishers’ own authentication services. We do not promise that any of it will be uninterrupted or error-free.

  • Planned maintenance. We schedule maintenance that may interrupt service outside peak hours where we can, and we announce it in advance through our status page and Discord. Most maintenance does not require downtime.
  • Emergency maintenance and incidents. Where a fault, a security issue or a provider-side outage requires immediate action, we may act without notice. We will post what happened and what we changed afterwards.
  • Provider outages. An AWS region going down, or a DNS provider failing, is outside our control. Where we can move a server, we will; where we cannot, we will be honest about it.
  • Your responsibility to be reachable. Keeping the email address on your account current is a condition of receiving notices under these Terms.

10.Suspension, termination and what happens to your data

You may close your account at any time from the dashboard. Closing it cancels your servers.

We may suspend or terminate your access, in whole or in part, if you materially breach these Terms - in particular section 4 - if we are required to by law, if your account is being used to harm other customers or our infrastructure, or if your payment remains unresolved after the grace period. Except where the risk is immediate, we will tell you why and give you the opportunity to put it right.

What happens to your data afterwards:

  • On termination, your servers are stopped and their data is queued for deletion.
  • Data is retained for a short window - the current backup retention period for your plan, and no longer than 30 days - so that an accidental cancellation or a billing failure is recoverable. During that window, contacting support may be able to restore it.
  • After the window, world data, backups, configuration and your account record are deleted from production systems. Copies may survive briefly in encrypted backups and in provider logs before rolling off; we do not restore from those to serve a terminated account.
  • Where we are legally required to preserve records - for example, billing records for tax purposes, or data subject to a lawful preservation order - we retain those for the required period.
  • Download your world before cancelling. Once the retention window passes, it is gone and we cannot get it back.

Sections that by their nature should survive termination - including 6, 11, 12 and 14 - survive it.

11.Disclaimer of warranties

The service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the service will meet your requirements, that it will be uninterrupted, timely, secure or error-free, that a particular game version, plugin or modpack will work, that data stored on the service will not be lost or corrupted, or that defects will be corrected.

You use the service at your own discretion and risk. You are solely responsible for the consequences of running third-party code on it and for maintaining your own copies of anything you cannot afford to lose.

Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited, including your statutory rights as a consumer where you have them.

12.Limitation of liability

To the fullest extent permitted by law, Lavender Software Development is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity, however caused and regardless of the theory of liability - even if we were advised that such loss was possible.

Our total aggregate liability arising out of or relating to the service is limited to the greater of (a) the amount you paid us for the affected server in the twelve months preceding the event giving rise to the claim, or (b) fifty US dollars.

We are not liable for events outside our reasonable control, including AWS or other provider outages, network failures, denial-of-service attacks, acts of government, or failures of game publishers’ services.

Nothing here limits liability that cannot lawfully be limited, such as for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

13.Changes to these Terms

We may revise these Terms as the service changes. When we do, we update the “Last updated” date at the top of this page, and - for any change that materially affects your rights or obligations - we give notice by email and in the dashboard at least 14 days before it takes effect.

If you continue to use the service after a revision takes effect, you accept the revised Terms. If you do not accept them, stop using the service and cancel your account before the effective date; where a revision materially reduces what you get for a period you have already paid for, we will refund the unused portion on request.

14.Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Lavender Software Development is established, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before starting formal proceedings, you and we agree to attempt to resolve any dispute informally: write to support@octic.host with a description of the problem and the outcome you are looking for, and give us 30 days to respond. Most disputes are a misconfiguration, and this step is usually faster than anything else.

If a dispute cannot be resolved informally, it is subject to the exclusive jurisdiction of the courts of that jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or to prevent misuse of the service.

If any provision of these Terms is found unenforceable, that provision is limited or severed to the minimum extent necessary, and the remaining provisions stay in force. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the service.
